1. Refund and Return Circumstances

Miraya Alhayl aims to provide customers with quality products and reliable service. Returns, replacements, and refunds will be handled in accordance with the applicable laws and regulations of the Sultanate of Oman and the specific terms applicable to the relevant product or order.

(a) Defective or Non-Conforming Products:

If a product received from Miraya Alhayl is defective, damaged, does not conform to the agreed specifications, or is otherwise not fit for its intended purpose, the Customer may be entitled to a replacement, return, repair, or refund in accordance with applicable laws, regulations, warranty terms, and the circumstances of the case.

The Customer may be required to provide proof of purchase and reasonable evidence of the defect, damage, or non-conformity. The defect must not have resulted from misuse, improper handling, or other actions attributable to the Customer.

(b) Non-Delivery:

If an order has not been delivered within the applicable delivery period, the Customer may contact Miraya Alhayl to investigate the order status and determine the appropriate resolution in accordance with the applicable terms and laws.

(c) Damaged Products:

If a product is received in a damaged condition, the Customer should notify Miraya Alhayl as soon as reasonably possible and provide the order details and supporting evidence, such as photographs where appropriate.

(d) Incorrect Products:

If the Customer receives a product that differs from the product ordered, the Customer should contact Miraya Alhayl as soon as reasonably possible. After verification, the Company may arrange an appropriate replacement, return, or refund in accordance with the applicable terms and laws.

2. Non-Refundable Circumstances

Except where a Customer has a legal right to return, replace, repair, or obtain a refund, the following circumstances may not qualify for a refund:

(a) Products Damaged Through Customer Misuse:

Products damaged as a result of misuse, improper storage, improper handling, or failure to follow the applicable product instructions may not qualify for a refund or replacement, to the extent permitted by applicable law.

(b) Products Altered by the Customer:

Products that have been materially altered, modified, or damaged by the Customer after delivery may not qualify for a refund or replacement, except where otherwise required by applicable law.

(c) Products Without Proof of Purchase:

Miraya Alhayl may require reasonable proof of purchase before processing a return, replacement, or refund, subject to applicable consumer protection requirements.

3. Refund Amount and Processing

Where a refund is approved, the refund amount and any applicable deductions will be determined in accordance with the applicable laws, regulations, product terms, and circumstances of the transaction.

Miraya Alhayl will not apply deductions or fees that are prohibited by applicable consumer protection laws.

4. Refund Request Process

(a) Contact Requirements:

Customers may contact Miraya Alhayl at info@mirayaalhayl.com with their order details, including the product purchased and a description of the reason for the return or refund request.

(b) Verification Process:

Miraya Alhayl may review the request and may require reasonable supporting documentation, photographs, proof of purchase, or other information necessary to assess the request.

(c) Return and Refund Decision:

After reviewing the request, Miraya Alhayl will inform the Customer of the applicable resolution, which may include replacement, repair, return, refund, or another appropriate solution, depending on the circumstances and applicable requirements.

(d) Refund Processing:

Where a refund is approved, Miraya Alhayl will process the refund using the applicable payment method or another appropriate method permitted by the applicable payment provider and laws.

(e) Return of Products:

Where a return is required, the Customer may be provided with instructions regarding how and where the product should be returned. Returned products should be kept in an appropriate condition and accompanied by the relevant order or purchase information where applicable.

5. Refund Approval Standards

Refunds, returns, replacements, and repairs will be assessed based on the condition of the product, the circumstances of the order, the applicable warranty or sales terms, and the rights and obligations established under the laws and regulations applicable in the Sultanate of Oman.

General Provisions

Indemnification

To the extent permitted by applicable law, the Customer agrees to be responsible for claims or liabilities arising from the Customer’s misuse of products or breach of the applicable terms and policies.

Limitation of Liability

To the extent permitted by applicable law, Miraya Alhayl‘s liability in connection with a product or order shall be limited to the applicable rights and remedies available under the relevant transaction and applicable laws. Nothing in this policy is intended to exclude or restrict any consumer right or legal protection that cannot lawfully be excluded or restricted.

Force Majeure

Neither party shall be responsible for delays or failure to perform caused by circumstances beyond its reasonable control, including supply chain disruptions, natural disasters, emergencies, or government actions, subject to applicable laws and regulations.

Dispute Resolution

These policies shall be interpreted and applied in accordance with the applicable laws and regulations of the Sultanate of Oman. The parties will seek to resolve any dispute amicably through direct communication and negotiation. If an amicable resolution cannot be reached, the dispute may be referred to the competent authorities and courts in the Sultanate of Oman.

Confidentiality

Both parties shall maintain the confidentiality of private and commercial information exchanged in connection with their business relationship and shall not disclose such information to third parties except with the other party’s consent or where disclosure is required by law.

Severability

If any provision of these policies is determined to be invalid or unenforceable, the remaining provisions shall continue to remain valid and enforceable to the extent permitted by applicable law.

Amendment and Modification

Miraya Alhayl reserves the right to amend or update these policies when necessary. Updates may be published on the website or communicated to customers through appropriate means.

Integration with Other Agreements

These policies form part of the terms governing purchases and transactions with Miraya Alhayl. Where specific terms are stated in an invoice, purchase order, warranty, or written agreement, those terms shall apply to the relevant transaction to the extent permitted by applicable law.

Acceptance and Binding Effect

Customer Acknowledgment

By purchasing products from Miraya Alhayl, making payments, or accepting deliveries, the Customer acknowledges that they have read and understood these policies and agree to comply with the applicable terms of the transaction, subject to the rights provided by applicable law.

Miraya Alhayl reserves the right to update these policies from time to time to reflect changes in its business practices and applicable requirements. Material changes may be communicated through the website or other appropriate means.
